1 Acceptance of terms
By adding NexGuard ("the Service", "the bot") to a Discord server, or by using its web dashboard, you agree to these Terms of Use. If you do not agree, do not add or use the Service. These Terms apply to server administrators who install the bot and to members of servers where it is active.
2 Description of the Service
NexGuard provides moderation, logging, anti-nuke, ticketing, role management, and related server-management features for Discord, configurable through a web dashboard. Features may be added, changed, or removed at any time as the Service evolves.
3 Acceptable use
You agree not to use the Service to:
- Violate Discord's Terms of Service or Community Guidelines.
- Break any applicable law or regulation.
- Harass, abuse, or harm others, or facilitate such behaviour.
- Attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its infrastructure.
- Use the Service to store or distribute unlawful content.
You are responsible for how you configure and use the Service within your server, including the moderation actions it performs on your behalf.
4 Availability & changes
The Service is provided on a best-effort basis. We do not guarantee uninterrupted or error-free operation, and we may suspend, limit, or discontinue all or part of the Service at any time, with or without notice. Scheduled maintenance may temporarily make commands unavailable.
5 No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, reliability, or availability. You use the Service at your own risk.
6 Limitation of liability
To the maximum extent permitted by law, NexGuard and its operator shall not be liable for any indirect, incidental, or consequential damages, loss of data, loss of profits, or server disruption arising from the use of, or inability to use, the Service. This does not exclude liability that cannot legally be excluded under the laws of Germany.
7 Data & privacy
Your use of the Service is also governed by our Privacy Policy, which explains what data we process and your rights under the GDPR. By using the Service, you acknowledge that you have read it.
8 Termination
You may stop using the Service at any time by removing the bot from your server. We may suspend or terminate access to the Service for any user or server that violates these Terms, abuses the Service, or poses a risk to other users or to the infrastructure.
9 Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10 Governing law
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any disputes arising from these Terms or the use of the Service shall be subject to the competent courts of Germany, to the extent permitted by applicable law.
